The Law holds that motorists in California could be fined for failing to slow down or move over when passing parked emergency vehicles.

I recently found this story regarding the Move-over Law:

I wanted to let my Medlock Bridge neighbors know about the move over law. My son got a ticket on Pleasant Hill coming back from Wal-Mart. A Duluth police car (turned out it was 2 police cars) was on the side of the road giving a ticket to someone else. My son slowed down to pass but did not move into the other lane. The second police car immediately pulled him over and gave him a ticket. My son and I had never heard of the law. It is a fairly new law that states if any emergency vehicle is on the side of the road, if you are able, you are to move into the next lane or slow down to 20 miles below the posted Speed limit.

As the cost of the ticket was $754, with 3 points on your license and a mandatory court appearance, it seems like an important law to share.  Beware people!

This story has gone viral, and I noticed that one respondent to this story (on another website) discovered that the original writer was speaking about Gerogia (abbreviated as GA).

Apparently someone cut and pasted this entire paragraph, and changed GA to CA. Makes sense to me, bcz when you Google all the locations in the story, you’ll see that they are in suburban Atlanta.

I’m still looking online for specific chapter and verse of the California law, eff 1/1/10. The earlier California law came with an expiration date of 1/1/10 – and I can’t believe the State of CA would let the law expire.

I thought it was a reasonable law. No one likes to pay a ticket, but no one wants to see a peace officer killed by a thoughtless, or uncaring, driver who does not give the officer room to do his work.

Let’s talk this over, and inform each other about the current CA law, so we can prevent a huge fine and points on our license.

  2. Mary,
I found this link below with briefly describes a 2 new move over laws. It’s the second one down. Let me know if this seems valuable and we will write another blog on this.

The “move over” law has been in effect in CA since 2007. It originally had an expiration date of 2010, but was made permanent. In CA, infraction of this law caries a maximum fine of $50. No mention is made by the vehicle code of points on one’s licence.

    It’s vehicle code section 21809
